These Terms of Service (the “Terms”) govern your access to and use of the website skadigitalstudio.com and any related services, software, mobile applications, and digital products (collectively, the “Services”) provided by SKA Digital LLC, a limited liability company organized under the laws of the State of Wyoming, USA (“SKA Digital”, “we”, “us”, or “our”).

6. Fees and payment

Recurring charges, if any, will continue until cancelled in accordance with the cancellation procedure provided for the relevant Service.

7. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. SKA DIGITAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR COMPLETELY SECURE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKA DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

SKA DIGITAL'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO SKA DIGITAL IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless SKA Digital, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Services, (ii) your violation of these Terms, or (iii) your violation of any third‑party right.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease, but Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may modify these Terms from time to time. The updated version will be indicated by a revised “Last updated” date. Material changes will be communicated through the website or by email when appropriate. Your continued use of the Services after the changes become effective constitutes your acceptance of the revised Terms.

13. Miscellaneous

These Terms constitute the entire agreement between you and SKA Digital regarding the Services and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
